1. Ownership and License Grant:

• By submitting your video to Gym Art, you irrevocably assign all ownership rights, including intellectual property rights, of the video to Gym Art. This assignment grants Gym Art the unrestricted right to reproduce, distribute, publicly perform, display, and create derivative works from the video in any format or medium at any time.

• You grant Gym Art the right to use the video for any purpose, including but not limited to promotional activities, educational sessions, and public displays within and outside of the Gym Art application.

2. Representations and Warranties:

• You represent and warrant that the video is your original creation and that you have the legal right to assign the rights to Gym Art. You assert that the video does not infringe on any third party's copyrights or any other rights.

• You agree to indemnify and hold harmless Gym Art from any claims, losses, liabilities, damages, fees, expenses, and costs (including attorneys' fees and court costs) that result from a breach of these warranties.

3. Use of the Video:

• Gym Art reserves the right to edit, alter, anonymize, or otherwise change the content of the video at its discretion.

• Gym Art may use the video globally for any lawful purpose, including but not limited to marketing, promotional materials, educational tools, and as part of the application functionality.

4. Credit and Acknowledgement:

• Gym Art may, but is not obligated to, credit you as the source of the video. The manner, presence, and scope of such accreditation are subject to Gym Art’s discretion and may vary.

5. Removal and Non-Use:

• Gym Art retains the right to remove or refrain from using the video at any time, without prior notice or liability to you.

6. No Compensation:

• You understand that you will not receive any compensation for the use of your video by Gym Art, regardless of the manner of use.

7. Privacy and Data Use:

• Personal Information: If any personal information is included in the video, you consent to its collection, processing, and use by Gym Art. Personal information includes, but is not limited to, names, faces, voices, and locations that can identify you or others in the video.

• Data Handling: Gym Art will handle personal data in accordance with applicable data protection laws. Gym Art commits to taking appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of data.

• Data Usage: The information collected can be used for legal, business, and marketing purposes in a manner that complies with the laws of the jurisdictions in which Gym Art operates.

8. Governing Law and Jurisdiction:

• These terms are governed by the laws of the jurisdiction where Gym Art is headquartered. Any disputes related to these terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.

By submitting your video to Gym Art, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
